Privacy declaration

We understand that your trust in us is the most important asset of Impact Coaching, Content division of MW Core Development BV (hereinafter referred to as “Impact Coaching”, “we” or “us”). Your information is therefore essential to us.

Current Privacy Statement (hereinafter referred to as “Privacy Statement”) applies, among other things, to (i) our website www.impactcoaching.be (hereinafter referred to as the “Website”), (ii) visiting the buildings and/or the establishment of Impact Coaching and (iii) all (commercial) relationships between Impact Coaching and its customers, prospects, business partners as well as those persons who have subscribed to its magazine.

This Privacy Statement includes information about the personal data that Impact Coaching collects, as well as the way in which Impact Coaching uses and processes this personal data.

Impact Coaching would like to emphasize that it always tries to act in accordance with the “info legislation”, namely (i) the Belgian info law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, (ii) the EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC and (iii) the (future) Belgian legislation regarding the implementation of the aforementioned Regulation.

Visiting the Website, calling upon the services of Impact Coaching, purchasing products/goods from Impact Coaching, subscribing to the newsletter, registering for a seminar or event of Impact Coaching as well as any and any form of communication with Impact Coaching implies your explicit approval (by means of communication of your personal data or opt-in) of the Privacy Statement and thus of the way in which Impact Coaching collects, uses and processes your personal data.

I. Types of Personal Data

Impact Coaching can collect and process the following personal data:

  • Name
  • First Name
  • E-mail address
  • Telephone number (landline and/or mobile)
  • Residential address
  • Clientnumber
  • Camera images
  • Company Name
  • Company Address
  • Billing address
  • Social media data
  • Communication preference
  • IP-address
  • All personal data contained in the free field of the contact form
  • All other personal data voluntarily transferred to Impact Coaching (for example during correspondence).

Impact Coaching also automatically collects anonymous information regarding your use of the Website. For example, Impact Coaching will automatically log which parts of the Website you visit, which web browser you use, which website you visited when you accessed the Website. We cannot identify you on the basis of this data, but it allows Impact Coaching to compile statistics regarding the use of the Website.

II. Method of collecting personal data

This personal data is collected at or in the context of:

  • Visit of the Website
  • A collaboration with Impact Coaching
  • Correspondence with and based on Impact Coaching
  • Visiting the buildings and/or the location of Impact Coaching
  • Requesting a quotation
  • Registering for an Impact Coaching seminar and/or event
  • The use you make of the services of Impact Coaching
  • Subscribing to the Impact Coaching newsletter (regardless of whether this is done via the website or physically)
  • Exchanging business cards
  • The verification of your identity

The personal data collected by Impact Coaching is thus expressly and voluntarily provided by you.

The provision of certain personal data is (sometimes) a condition to be able to enjoy certain services (e.g. to access certain parts of the Website, to subscribe to newsletters, to participate in certain activities and events). It is indicated which data are mandatory and which are optional.

III. Use of personal data

Impact Coaching can use your personal data for the following purposes:

  • The execution of an agreement with Impact Coaching (including its follow-up)
  • Answering questions (whether or not asked via the contact form)
  • Optimizing the quality, management and content of the Website
  • Sending newsletters
  • Statistical Purposes
  • Formatting a quote
  • Follow up after a meeting
  • Sending targeted marketing and advertising, updates and promotional offers based on your communication preference and – where applicable – on the basis of your explicit consent
  • Conducting customer satisfaction surveys, surveys and other market research
  • Confirmation of registration for an Impact Coaching seminar and/or event
  • Sending invoices and collecting payments
  • Sending you our brochures

The processing takes place on the following legal bases, as the case may be:

  • You have given permission for the processing of your personal data for one or more specific purposes
  • The processing is necessary for the execution of the agreement with Impact Coaching or to take measures at your request before entering into an agreement
  • The processing is necessary to comply with a legal obligation that rests on Impact Coaching
  • The processing is necessary for the purposes of the legitimate interests of Impact Coaching or of a third party, except when your interests or fundamental rights and your fundamental freedoms that require the protection of personal data outweigh those interests (in particular if you are a minor).

IV. Disclosure of personal data to third parties

Impact Coaching will not disclose your personal data to third parties, unless it is necessary in the context of the implementation of the agreement and its optimization (such as but not limited to the processing of payments, sending deliveries and in the provision of services to Impact Coaching). In this context, your personal data may be disclosed to payment providers, software suppliers, cloud partners, transport partners, external IT consultants, financial institutions, insurance companies, government and other legal authorities as well as to external service providers.

If it is necessary for Impact Coaching to disclose your personal data to third parties in this context, the third party concerned is obliged to use your personal data in accordance with the provisions of this Privacy Statement.

Notwithstanding the foregoing, it is however possible that Impact Coaching discloses your personal data:

  • To the competent authorities (i) when Impact Coaching is obliged to do so by law or in the context of legal or future legal proceedings and (ii) to safeguard and defend the rights of Impact Coaching.
  • When Impact Coaching or substantially all of its assets are acquired by a third party, in which case your personal information that Impact Coaching has collected will be one of the transferred assets.

In all other cases, Impact Coaching will not sell, rent or pass on your personal data to third parties, unless it (i) has obtained your permission for this and (ii) has concluded a data processing agreement with the third party in question, which contains the necessary guarantees regarding confidentiality and info-compliant treatment of your personal data.

V. Cross-Border Processing of Personal Data

As a rule, we do not transfer your data to recipients who have their place of residence or registered office outside the European Economic Area. Should this nevertheless be necessary, any transfer of personal data outside the European Economic Area (EEA) to a recipient who has his domicile or registered office in a country that is not covered by an adequacy decision issued by the European Commission, will be governed by provisions of an data transfer agreement, which will either (i) contain the standard contractual clauses as stipulated in the ‘Decision of the European Commission of 5 February 2010 (Decision 2010/87/EC)’, or (ii) provide appropriate safeguards by any other mechanism on the basis of the Info Legislation or any other regulation regarding the processing of personal data.

VI. Storage of personal data

Unless a longer retention period is required or justified (i) by law or (ii) by compliance with another legal obligation, Impact Coaching will only store your personal data for the period necessary to achieve and fulfill the goals, as described in this Privacy Statement under ‘III. Use personal data’.

VII. Your information rights

In the context of the processing of your personal data, you have the following information rights:

  • Right to access your personal data;
  • Right to rectification, completion or update of your personal data;
  • Right to erasure of your personal data (‘right to be forgotten’) (In this context, Impact Coaching points out that certain services will no longer be accessible or can no longer be provided if you delete certain necessary personal data or have them deleted);
  • Right to a restriction of the processing of your personal data;
  • Right to portability of your personal data;
  • Right to object/oppose the processing of your personal data.

If you no longer wish to receive newsletters or information about the services, products and/or goods of Impact Coaching, you can unsubscribe at any time by clicking on the “unsubscribe” button, as provided at the bottom of each email from Impact Coaching.

VIII. Security of personal data

Impact Coaching undertakes to take appropriate and reasonable physical, technological and organizational security measures with a view to preventing (i) unauthorized or unlawful access to your personal data, as well as (ii) loss, misuse or alteration of your personal data.

Impact Coaching will store all personal data it has collected on the server on its site, as well as possibly in a backup in the cloud with data centers in the EU.

Notwithstanding (i) Impact Coaching’s security policy, (ii) the checks it carries out and (iii) the actions it takes in this context, an infallible level of security cannot be guaranteed. No method of transfer or forwarding via the internet nor any method of electronic storage is 100% secure, so that Impact Coaching cannot guarantee absolute security in this context.

IX. Update Privacy Statement

Impact Coaching is entitled to update this Privacy Statement by placing a new version on the Website. In this context, it is strongly recommended that you regularly consult the Websites and the relevant page on which the Privacy Statement is displayed to ensure that you are aware of any changes.

X. Links to other websites

The Website may contain hyperlinks to other websites. When you click on one of these links, you may be going to another website or Internet resource that may collect information about you knowingly or through cookies or other technologies. Impact Coaching bears no responsibility, liability or control authority over these other websites or internet resources, nor over their collection, use and dissemination of your personal data. You must check the information policy of these other websites and internet sources yourself in order to judge whether they act in accordance with the information legislation.
